GENERAL SALES CONDITIONS

1.    APPLICABILITY

1.1 Unless another written agreement, all sales of goods by Euro-Scientific BV are executed in accordance with these terms. Each order means customer acceptance of our term and conditions.

1.2 No deviation of these general terms and conditions is allowed without explicit and written authorization of Euro-Scientific BV.

No condition which text appears on the clients documents  is accepted by Euro-Scientific BV. 

 2.    COMPLAINTS

2.1  The customer must check the goods at delivery and check whether the delivered  goods correspond to the ordered goods. Allvisible defects or errors in our products must be reported by the customer within 10 working days after receiving the goods. No claim is admitted after this period.

2.2  Sending in complaints never gives the customer although the right to suspend its own payment.

 3.    Payments

  3.1 Payments shall be made by a transfer to one of the accounts indicated on the invoice of  Euro-Scientific BV, without discount, unless there is an otherwise agreed payment. In case of non-payment or partial payment on the due date, all outstanding invoices are payable immediately and all discounts and payment facilities expire.

  3.2 From the due date of the invoice the amount due realizes, by law and without prior notice, an interest per month equal to the interest rate applicable according to the Law of 02/08/2002 on late payments in commercial transactions.

  3.3 If the delay of the payment on an outstanding invoice exceeds 30 days, the claim shall be increased of 10% of the invoiced amount and with a minimum of € 50,00. This is done by law and without prior notice according to the Law of 02/08/2002 on late payments in commercial transactions.

 4.    RETENTION OF TITLE

The sold goods remain until full payment of the respective invoices, property of Euro-Scientific BV.

 5.    CANCELLATION

An order can only be cancelled by the customer if expressly agreed by Euro-Scientific BV.

 6.    COMPETENT JURISDICTION AND APPLICABLE LAW

Each contract is exclusively governed by Belgian law. Only the courts of the place of the registered office of Euro-Scientific BV are authorised to hear any disputes.

 7.    FRANCO DELIVERY

For orders with a value of less than € 300,00 (excluding VAT), delivered in Belgium, € 25,00 shipping and administration costs are charged. All other orders are delivered free, unless otherwise specified. For deliveries abroad, packaging and shipping costs are always charged.

   8. DELIVERY TIME

       The delivery time of Euro-Scientific BV are approximate and informative.

 9.    SHIPMENT

All risks and costs regarding the transport are for the buyer’s account, even if executed franco and by our own services. There is no return of the goods accepted without prior approval of Euro-Scientific BV.

 10.   CONFIDENTIALITY

All information exchanged between different parties in the context of a cooperation and considered confidential or that should reasonably be considered confidential, may not be disclosed, disseminated or made available to third parties without the written permission of the other party, with the exception of employees, subcontractors or personnel who must have a direct knowledge of it for the implementation of the cooperation and who have subscribed to a similar confidentiality obligation. Such information may not be used for purposes other than the implementation of obligations under the cooperation.

11.     PROTECTION OF PERSONAL DATA

Euro-Scientific and the customer and/or supplier acknowledge that the processing of personal data in the context of the cooperation will be applicable from 25 May 2018 to Regulation (EU) 2016/679 (hereinafter: the “GDPR”).Euro-Scientific declares that it will comply with the privacy regulations (including the Privacy Act and / or the GDPR). The person responsible for processing the personal data is Euro-Scientific, with registered office at Learningfield 12, 2547 Lint with company number 0421.117.778.

  1. Euro-Scientific processes the personal data for the following purposes:
    a. Application of the Law of 18 September 2017 on the prevention of money laundering and the financing of terrorism and on the restriction of the use of cash.
    b. The processing of personal data is necessary for the proper functioning of Euro-Scientific. Without this information we cannot enter into a business relationship with our customer.

    Within the framework of these purposes, Euro-Scientific can process the following personal data: name, address, telephone number, fax number, email address, language, VAT number, cookies, etc.

    Euro-Scientific processes personal data which the data subjects have supplied in all possible ways. It is therefore about data from our current clients, suppliers, clients, but also about potential customers and potential suppliers.

    Euro-Scientific does not share personal information with third parties, except to the extent that this is necessary for our legitimate professional and business needs or for processing your requests, and / or to the extent that legal provisions or professional standards prescribe or permit this.

    In order to prevent, as far as possible, unauthorized access to the personal data collected in this context, Euro-Scientific has established procedures in the field of security and organization, which relate to both the collection of this data and their retention . Access to this personal data is protected by password protection, virus scanners, firewall, etc.
    This data is only stored within the walls of Euro-Scientific and is only accessible to employees of Euro-Scientific.

    The personal data collected is stored for as long as it is necessary to ensure operation between the customer and Euro-Scientific and / or between the supplier and Euro-Scientific.

    As a customer and / or as a supplier you always have the right to view and correct your personal data. You have the right to receive confirmation that we process personal data about you and to request a free copy of the personal data we hold about you. If the information we hold about you is incorrect, you can ask us to correct all inaccuracies in the personal data.

    The customer and / or supplier has the right to delete all data relating to his personal data (except in some cases, for example to prove a transaction, payments or when required by law).
    You can submit a request or exercise these rights by contacting Euro-Scientific at info@euro-scientific.be and we will make all reasonable and practical efforts to comply with your request, provided that this is in accordance with the applicable legislation and professional standards.

    Regarding the processing of personal data by Euro-Scientific, you can submit a complaint to the data protection authority:
